retainer, payment, and cancellation

The Client shall submit a session fee when reserving their portrait session. They will be emailed a copy of the contract that they will sign digitally to reserve their portrait session's date and services. If the session is rescheduled or canceled by the Client, the retainer will not be returned or applied towards the rescheduled session. The rescheduled session will require a new session retainer to secure the new date. The session fee includes 15 minutes of photography time at a predetermined location by the photographer and does not include any prints or digital files. Any charges incurred in shipping prints or products will be billed to the Client. To schedule a portrait session for a new calendar year, the applicable pricing may be different and will correspond with that year’s published prices. 

copyright, rights to use, and reproductions

LIL BITTY RANCHO owns the rights to all images collected from the event and retains the rights to reproduce any images produced in connection with this agreement. It is a violation of Federal Copyright Law to allow photographs created by LIL BITTY RANCHO to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered without our written permission. The Client agrees to purchase prints and products directly from LIL BITTY RANCHO at least until after taking possession of high-resolution digital files (if purchased). The parties agree that LIL BITTY RANCHO may reproduce, publish, or exhibit (with the highest standards of taste and judgment) any images taken at the event as samples of photographic work to be used to promote its business.

standard price list (this shop)

The charges in this agreement are based on LIL BITTY RANCHO's Standard Price List. This price list is adjusted periodically, and future orders shall be charged at the prices in effect at the time when the order is placed. Due to our products' custom nature, payments on all orders are final and will not be reimbursed. Purchases will include a low-res (800x640) watermarked copy of photos chosen for packages, artwork, prints, and digital negatives in your order. liability

While every reasonable effort will be made to produce and deliver outstanding photographs of the portrait session, LIL BITTY RANCHO’s entire liability to the Client for a claim, loss, or injury arising from the performance is limited to a refund to the Client of the amount paid for services, unless insurance claims must be filed. If insurance claims are filed, terms are deferred to the insurance agreement. As mentioned above, if the Client cancels services for any reason, the retainer paid is non-refundable. In the event of personal illness or other circumstances beyond the control of LIL BITTY RANCHO and the obligations of photography cannot be fulfilled on the date requested by the Client, the Client may elect to terminate this agreement and receive a full refund of all deposits made to LIL BITTY RANCHO, or the Client may reapply the deposit if the portrait session is rescheduled to a later date within the same calendar year. In the event of rain for an outdoor event, while the photographer will make every effort to continue photographic coverage, if it becomes impossible due to weather, the photographer is not responsible for any images not acquired during this time.

assumption of risk

I agree as a precondition to my participation in this portrait session by the LIL BITTY RANCHO or its Employees. In further consideration of LIL BITTY RANCHO allowing me to do so, to be strictly bound by the terms of this agreement, assumption of risk, and indemnity agreement. I acknowledge that pony rides and activities with live animals involve inherent risks that may cause serious injury and possibly death to participants. I fully understand the risks and dangers associated with a child’s (or my personal representative, heirs, or assigns) participation in the event and accept the same entirely at my own risk.

waiver

I hereby waive any and all claims, which I may have against The Farm, and/or its
Employees, and release LIL BITTY RANCHO and its employees from all liability for injury, death, property damage, or any other loss sustained by me or my child (or the child I am representing) as a result of my/their participation in the event, due to any cause whatsoever including, without limitation, negligence on the part of LIL BITTY RANCHO or its employees, for any and all legal fees (on a solicitor and his own client basis) or costs, which may be incurred in defending any lawsuit or claim I may bring against them.

portrait session and premiere terms 

We will show anywhere from 20 to 35 images from an average mini session. If the total number of images is above or below this amount, no credits are given, or extra charges are applied.
Proofs will be completed within two weeks of your session date. On or after your session, we will schedule a time for your personalized online gallery premiere date. You will be able to view all the images, browse our product offerings and print sizes, and place your print and product orders from your online gallery. Your images will be available for two weeks to share with family and friends;
If additional hours are required or requested for your session, they will be billed at $100 per hour.

We ask that all cell phones or recording devices not be out during our sessions. No video or photography from any device other than those used by our photographer(s) is allowed.

storage and release of digital negatives 

Due to the large amount of storage space required for today’s digital imaging technology and a large number of images we create per year, we can only guarantee to keep your image files in our system for 30 days. After 30 days, all unordered images will be deleted from our system, so it is highly recommended that the Client purchase the high-resolution digital files should he/she want to keep them. If additional time is required for online proofing, a re-posting fee of $50 will be incurred, and the online gallery will be reposted for 7 days. By releasing the high-resolution digital files, LIL BITTY RANCHO authorizes the Client to use the images for personal use only. The images may not be sold or published without the written consent of LIL BITTY RANCHO. Low-resolution files used by the Client shall not be altered in any way, including cropping or removing the watermark.

miscellaneous

This agreement incorporates the entire understanding of the parties. Any modifications of this agreement must be in writing and signed by both parties. The Client has received, read, and agrees to all terms of copyright in this agreement and agrees to relay this contract's details to any and all subjects involved in the session.

Warning: Under Texas Law (Chapter 87, Civil Practice and Remedies Code), a farm animal professional is not liable for an injury to or the death of a participant in farm animal activities resulting from the inherent risks of farm animal activities.

Lil Bitty Rancho is a DBA and trademark of Rancho Condarco LLC. We will supply 'Proof of Liability Insurance, Horse Well-checks (Coggins), USDA Certificate, and W-9 when requested.
